These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "Customer", "Client") and Hexacraft ("Company", "we", "our", "us"). These Terms govern your access to and use of all services provided by Hexacraft, including but not limited to our website, billing portal, control panels, APIs, infrastructure, virtual servers, game hosting environments, networking services, and any related features or functionality (collectively, the "Services").
By registering an account, purchasing any service, or otherwise accessing or using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms, along with our Privacy Policy, Acceptable Use Policy (AUP), and any additional policies or agreements referenced herein.
If you do not agree to these Terms, you must immediately discontinue use of all Services.
1. Eligibility and Legal Capacity
- 1.1 You must be at least fourteen (14) years of age or the minimum legal age required in your jurisdiction to enter into a binding agreement.
- 1.2 If you are entering into this agreement on behalf of a company, organization, or other legal entity, you represent and warrant that you have the full legal authority to bind such entity to these Terms.
- 1.3 Hexacraft reserves the right, at its sole discretion, to request identity verification, including but not limited to government-issued identification, proof of address, or business registration documents.
- 1.4 Services may not be used in jurisdictions where such use is restricted or prohibited by applicable law, including but not limited to sanctioned regions or individuals subject to trade restrictions.
- 1.5 We reserve the right to refuse service to any individual or entity at our sole discretion where permitted by law.
2. Account Registration and Security
- 2.1 You agree to provide accurate, complete, and up-to-date information during registration and throughout your use of the Services.
- 2.2 The use of false identities, fraudulent information, or misleading account details is strictly prohibited and may result in immediate suspension or termination.
- 2.3 You are responsible for maintaining the confidentiality of your account credentials, including usernames, passwords, API keys, and access tokens.
- 2.4 Any activity conducted through your account shall be deemed your responsibility, regardless of whether such activity was authorized.
- 2.5 You must notify Hexacraft immediately of any unauthorized access or suspected breach of your account.
- 2.6 Creating multiple accounts to bypass limits, restrictions, or enforcement actions is strictly prohibited.
- 2.7 Hexacraft reserves the right to suspend, restrict, or terminate accounts pending verification or in response to suspicious activity.
3. Description and Scope of Services
- 3.1 Hexacraft provides infrastructure-based hosting services, including but not limited to: Minecraft server hosting environments, Virtual Private Servers (VPS), Network routing and connectivity, Storage and compute resources, Add-ons, upgrades, and auxiliary services.
- 3.2 All Services are provided on an "as-is" and "as-available" basis, without warranties of any kind, whether express or implied.
- 3.3 Hexacraft does not guarantee uninterrupted access, error-free operation, or complete security of Services.
- 3.4 We reserve the right to modify, suspend, or discontinue any aspect of the Services at any time, with or without notice, including resource allocations, features, or pricing.
- 3.5 Services are provided as infrastructure only unless explicitly stated otherwise. Managed services, system administration, or technical customization may require separate agreements or fees.
4. Minecraft Hosting Terms
- 4.1 You are solely responsible for all content hosted on your Minecraft server, including but not limited to worlds, plugins, mods, scripts, and player data.
- 4.2 You agree to comply with all applicable rules and guidelines established by Mojang Studios and its parent company Microsoft, including but not limited to the Minecraft End User License Agreement (EULA).
- 4.3 The following activities are strictly prohibited: Operating cracked or unauthorized servers in violation of official policies; Using malicious plugins, backdoors, crypto miners, or unauthorized scripts; Collecting, storing, or misusing player personal data without proper consent; Intentionally overloading server resources to impact infrastructure stability.
- 4.4 Hexacraft does not actively monitor gameplay or server content but reserves the right to investigate and take action in response to abuse reports, legal requirements, or security concerns.
5. VPS and Administrative Access Responsibilities
- 5.1 Services that include root or administrative access grant you full control over your virtual environment.
- 5.2 You acknowledge and agree that you are solely responsible for: Server configuration and maintenance; Security hardening and firewall configuration; Installation, updating, and patching of software; Monitoring for unauthorized access or vulnerabilities.
- 5.3 Hexacraft does not provide system administration, security auditing, or configuration management unless explicitly purchased as a separate service.
- 5.4 Any VPS that is misconfigured, compromised, or used in a manner that negatively impacts the network or other users may be suspended immediately without prior notice.
- 5.5 You are responsible for ensuring that all software installed on your VPS complies with applicable laws and licensing requirements.
6. Payments, Billing, and Financial Obligations
- 6.1 All services are provided on a prepaid basis unless otherwise agreed in writing.
- 6.2 Services will only be activated after full payment has been received and verified.
- 6.3 You agree to pay all applicable fees, taxes (including GST where applicable), and charges associated with your account.
- 6.4 Invoices must be paid before the due date specified. Failure to do so may result in suspension or termination of Services.
- 6.5 Chargebacks, payment disputes, or unauthorized reversals will result in immediate suspension and may lead to permanent account termination.
- 6.6 Hexacraft reserves the right to engage collection agencies or legal processes to recover unpaid balances.
7. Customer Responsibility
- 7.1 You are solely responsible for actively monitoring your account, including: Active services and their status; Renewal dates and billing cycles; Outstanding invoices and account balance.
- 7.2 Failure to log in to your account or monitor billing information does not exempt you from payment obligations.
- 7.3 Hexacraft is not liable for service interruption, suspension, or data loss resulting from missed payments or account inactivity.
- 7.4 While we may send reminders or notifications, you are responsible for ensuring that your registered email address is valid, accessible, and regularly monitored.
- 7.5 Data associated with suspended services may be permanently deleted after a reasonable period without further notice.
8. Resource Usage and Fair Use Policy
- 8.1 All Services are subject to fair and reasonable usage to ensure system stability and performance for all users.
- 8.2 Excessive or abusive usage, including but not limited to sustained high CPU load, excessive memory consumption, or abnormal bandwidth usage, may result in throttling, suspension, or termination.
- 8.3 The use of automated scripts, infinite loops, or background processes that negatively impact infrastructure performance is strictly prohibited.
- 8.4 Hexacraft reserves the right to impose limits, adjust resource allocations, or take corrective action to maintain service quality.
9. Prohibited Activities
- 9.1 You may not use Hexacraft Services for any unlawful, harmful, or abusive activity, including but not limited to: Hosting or distributing malware, ransomware, or spyware; Phishing, fraud, or identity theft; Operating botnets or DDoS infrastructure; Sending unsolicited bulk communications (spam); Copyright infringement or piracy; Hosting illegal marketplaces or services.
- 9.2 Violations may result in immediate suspension, termination, and reporting to relevant authorities.
10. Data, Backups, and Loss
- 10.1 You are solely responsible for maintaining backups of all data hosted on our Services.
- 10.2 Hexacraft does not guarantee backup availability or data restoration unless explicitly stated.
- 10.3 We are not liable for data loss caused by hardware failure, security incidents, user error, or service interruptions.
- 10.4 You acknowledge that all data stored on our infrastructure is at your own risk.
11. Limitation of Liability
- 11.1 To the fullest extent permitted by law, Hexacraft shall not be liable for: Indirect, incidental, or consequential damages; Loss of profits, revenue, or business opportunities; Data loss or corruption.
- 11.2 Total liability shall not exceed the amount paid by you in the preceding thirty (30) days.
12. Suspension and Termination
- 12.1 Hexacraft reserves the right to suspend or terminate Services at any time, with or without notice, for: Violation of these Terms; Non-payment; Fraud or abuse; Security risks; Legal or regulatory requirements.
- 12.2 No refunds will be issued for accounts terminated due to violations.
13. Force Majeure
Hexacraft shall not be held liable for delays or failures caused by events beyond our reasonable control, including but not limited to natural disasters, war, cyberattacks, infrastructure outages, or government actions.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of India.

12. International Data Transfers
Your data may be stored or processed in different countries depending on infrastructure location. By using our Services, you consent to such transfers.
13. Your Data Rights
Depending on jurisdiction, you may request access to your data, request correction, request deletion, object to processing, or request data portability. Requests may require identity verification.
14. Account Deletion
Upon request active services will be terminated. Data may be permanently deleted, though billing records may be retained for legal reasons. Deletion does not cancel outstanding payment obligations.
15. Third-Party Services
Our platform may integrate third-party tools such as billing systems, control panels, and payment gateways. We are not responsible for third-party privacy practices.
16. Children's Privacy
Services are not intended for users under 14 years of age. We do not knowingly collect data from minors.
17. Business Transfers

18. Limitation of Liability

4. VPS Abuse
With root access, prohibited uses include:
- Botnets
- Spam servers
- Crypto mining (unless explicitly allowed)
- Brute-force attacks
- Network scanning
5. Network Abuse
Strictly prohibited:
- DDoS attacks
- Packet sniffing
- Exploiting vulnerabilities
- Unauthorized penetration testing
6. Resource Abuse
- Constant 100% CPU usage
- Excessive I/O operations
- Network saturation
May result in throttling or suspension.
7. Enforcement
We reserve the right to:
- Suspend or terminate services
- Remove content
- Restrict resources
- Report illegal activity
8. Zero Tolerance Violations
Immediate termination for:
- Child exploitation content
- Terror-related content
- Large-scale attacks
- Fraud operations
9. Customer Responsibility

3. Uptime Guarantee
- Target: 99.9% uptime
- Minimum guarantee: 99% uptime

7. Claim Process
